Terms of Service
These Terms of Service ("Terms") govern your access to and use of the FormFlow platform, including our website, mobile applications, and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account, accessing, or using FormFlow, you confirm that you are at least 18 years old, have the authority to bind your organization to these Terms, and agree to comply with all applicable laws and regulations.
2. Description of Service
FormFlow provides an offline-capable mobile forms platform for field data collection. The Service includes form building tools, offline data capture, automatic cloud synchronization, real-time dashboards, and data export capabilities.
3. Account Registration
You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized use.
4. Subscription and Payment
FormFlow offers Free, Pro, and Enterprise subscription plans. Paid subscriptions are billed monthly or annually as selected at sign-up. Prices are in US dollars unless otherwise stated. We may change pricing with 30 days' notice. Refunds are provided in accordance with applicable law.
5. Your Data
5.1 Ownership
You retain all rights to the data you and your team collect through FormFlow ("Your Data"). FormFlow does not claim ownership of Your Data.
5.2 License to FormFlow
You grant FormFlow a limited license to process, store, and transmit Your Data solely to provide the Service. This license terminates when you delete Your Data or close your account.
5.3 Data Portability
You may export Your Data at any time in CSV or PDF format through the platform's export features or via our API.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or to collect data without proper consent
- Attempt to gain unauthorized access to any part of the Service
- Interfere with or disrupt the Service or its infrastructure
- Reverse engineer, decompile, or disassemble any part of the Service
- Use the Service to store or transmit malicious code
- Resell or sublicense access to the Service without written permission
7. Intellectual Property
FormFlow and its licensors own all rights to the Service, including software, designs, trademarks, and documentation. These Terms do not grant you any rights to use FormFlow's trademarks or branding.
8. Service Availability
We strive to maintain 99.9% uptime for the cloud components of the Service. The offline capabilities of FormFlow function independently of cloud availability. We reserve the right to perform scheduled maintenance with reasonable advance notice.
9. Limitation of Liability
To the maximum extent permitted by law, FormFlow's total liability for any claims arising from your use of the Service shall not exceed the amount you paid to FormFlow in the 12 months preceding the claim. FormFlow shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
10. Indemnification
You agree to indemnify and hold harmless FormFlow from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your collection of data through the Service.
11. Termination
Either party may terminate these Terms at any time. Upon termination, your right to use the Service ceases immediately. We will make Your Data available for export for 30 days following termination, after which it may be deleted.
12. Governing Law
These Terms are governed by the laws of the Province of Quebec, Canada, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Montreal, Quebec.
13. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated via email or platform notification at least 30 days before taking effect. Continued use after changes constitutes acceptance.
